Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 2 of Chapter 2 of Title 2.2 a section numbered 2.2-203.2:2 as follows:

§ 2.2 -203.2:2. Continuity of operations; disaster planning.

A. The Secretary shall require each agency head to establish a process to identify every employee and on-site contractor present in buildings or facilities owned or leased by the Commonwealth. 

B. Identification of individuals shall be determined by a combination of technologies such that presence verification can be determined immediately upon the event that any facility, or portion of a facility, becomes unavailable for use because of a natural disaster or terrorist attack. 

C. The head of each agency shall report annually to the Secretary on the status of any programs or policies developed and implemented pursuant to this section. Any agency head failing to comply with the requirements of this section shall forfeit 1% of the moneys appropriated for the operation of the agency as provided in the appropriation act. The Secretary shall so notify the Comptroller, who shall take such moneys and deposit them into the Literary Fund.
