Be it enacted by the General Assembly of Virginia:

1.  That § 3.1-796.73 of the Code of Virginia is amended and reenacted as follows:

§ 3.1-796.73. Abandonment of animal; penalty.

A. No person shall abandon or dump any animal. Violation of this section subsection is a Class 3 misdemeanor. Nothing in this section shall be construed to prohibit the release of an animal by its owner to a pound, animal shelter, or other releasing agency.

B. It shall be unlawful for any person to abandon, dispose of, or dump a companion animal. Violation of this subsection is a Class 1 misdemeanor. Nothing in this section shall be construed to prohibit the release of an animal by its owner to a pound, animal shelter, or other releasing agency. Trapping, neutering, and releasing of feral cats does not constitute abandonment under the provisions of this section.
