Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-57.2:01 as follows:

§ 18.2-57.2:01.  Assault and battery against a family or household member in the presence of a child; penalty.

A.  Any person who commits a violation of § 18.2-57.2 knowing that a child under the age of 14 is present is guilty of a Class 2 misdemeanor.

B.  Violation of this section shall constitute a separate and distinct offense.
