Summary

Preliminary DUI breath analysis as evidence in prosecution.  Provides that the results of a preliminary DUI breath analysis may be admitted into evidence in any prosecution for a DUI offense for the purpose of rebutting a challenge by the defendant to the existence of probable cause for the arrest. Currently there is no statutory exception to the rule that it not be admitted into evidence.   View Full Text »
