Description

Civil cases; expert opinion testimony. Incorporates the current version of Federal Rule of Evidence 702 into the Code of Virginia for civil cases. In 2000, Federal Rule of Evidence 702 was amended in response to the United States Supreme Court decision in Daubert v. Merrell Dow Pharmaceuticals, 509 U.S. 579 (1993), which directed the court to analyze the importance of expert testimony based on specified factors and gave rise to the "Daubert" pre-trial hearing used to judge the admissibility of expert testimony outside the presence of a jury. Additionally, the bill adds a relevance requirement to the admissibility of opinion testimony by experts. Read the Bill »
