Description
State Board of Elections; Director of Elections. Increases the size of the State Board from three to five members. Provides for the position of Director of Elections to be hired by the State Board with the concurrence of at least four of its members, subject to confirmation by the General Assembly, as head of the elections agency, in place of the present position of the Secretary who is a member of the State Board appointed by the Governor. The Director may be removed only by a vote of at least four members of the State Board. This bill is a recommendation of a special subcommittee of the Senate Committee on Privileges and Elections appointed to study SB 989 (2005). Amends § 2.2-106 (“Appointment of agency heads; severance.”), § 24.2-101 (“Definitions.”), § 24.2-102 (“Appointment; terms; Secretary; prohibited activities.”), § 24.2-404.1 (“Secretary of State Board of Elections to serve as state coordinator for the administration of the National Voter Registration Act.”), § 24.2-411.2 (“State-designated voter registration agencies.”), § 24.2-502 (“Statement of economic interests as requirement of candidacy.”), § 24.2-644 (“Voting by paper ballot; voting for presidential electors; write-in votes.”), § 24.2-713 (“Emergency authority of the Secretary of the State Board of Elections.”), § 37.2-1014 (“Clerk to index findings of incapacity or restoration; notice to Commissioner, commissioner of accounts, Secretary of Board of Elections, and CCRE.”), of the Code of Virginia.
