Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Chapter 15 of Title 2.2 a section numbered 2.2-1515 as follows:

§ 2.2-1515. Designation of budget surplus for highway construction.

At the end of the second fiscal year in every two-year budget cycle, the Comptroller shall designate within his annual report pursuant to § 2.2-813 an amount for new highway construction that shall equal the amount of general fund surplus revenues remaining that are otherwise unappropriated. Such designation shall be made only if the full amounts required in § 2.2-1514 have been set aside.
