HB2034: Prisoners; payment for health care costs by local and state correctional facilities.
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 53.1-133.01:2 as follows:
§ 53.1-133.01:2. Health care costs for prisoners.
Payment by local and state correctional facilities for costs incurred for the provision of health care items, treatment, and services for prisoners in the custody of such facilities shall not exceed the lesser of the amount that would be paid for the provision of similar health care items, treatments, or services under (i) the Medicare program under Title XVIII of the federal Social Security Act or (ii) the Virginia Medicaid program pursuant to Title 32.1 of the Code of Virginia. Any payment for a health care item, treatment, or service made pursuant to this section shall be deemed to be full and final payment.
