Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 1 of Title 10.1 a section numbered 10.1-104.5 as follows:

§ 10.1-104.5. Application of pesticides and fertilizers; penalty.

No commercial provider of lawn care or landscaping services shall apply pesticides, fertilizers, or other sources of toxic or nutrient nonpoint source pollution onto streets, driveways, sidewalks, curbs, and gutters whether in solid or liquid form. Any person in violation of this section may be assessed a civil penalty not to exceed $250. All civil penalties imposed under this section shall be deposited into the Virginia Water Quality Improvement Fund (§ 10.1-2128 et seq.).
