HB2682: Local Partnership Programs; VDOT make sure funds are transmitted periodically to locality.
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 15 of Chapter 1 of Title 33.1 a section numbered 33.1-223.2:17 as follows:
§ 33.1-223.2:17. Local Partnership Programs.
When Local Partnership Programs are created, agreed upon, and entered into, and fully funded by the General Assembly in the general appropriation act, in addition to other details of the program, a schedule for advance payments of funds by the Department of Transportation to the locality shall be agreed upon. Such schedule of payments shall ensure that Departmental funds are transmitted, periodically to the locality with such frequency, on such dates, and in such amounts that, at no time, will the locality be obligated to fund any portion of the project, pending reimbursement by the Department. Such payment schedule shall minimally include designated dates on which funds shall be reimbursed by the Department of Transportation to the locality. Any Departmental funds advanced to the locality pursuant to this section shall be spent exclusively by the locality to fund the project for which the partnership was established.
