HB2811: Firearms; possession thereof in residences of mentally ill persons.
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-309.1 as follows:
§ 18.2-309.1. Possession of firearms in residences of mentally ill persons.
A. The Department of State Police, in cooperation with the Department of Mental Health, Mental Retardation and Substance Abuse Services, shall develop educational materials concerning the possession of firearms in homes occupied by mentally ill persons. Such materials shall include, but not be limited to, information concerning identification of signs of violence and the safe and secure storage of firearms, including the services provided pursuant to subsection B. The educational materials shall be available on the Virginia State Police website and the Department of Mental Health, Mental Retardation and Substance Abuse Services website.
B. The Virginia State Police shall provide for the safe storage of firearms, upon request by the owners of firearms residing in the same home as a mentally ill person, if such owner feels that possession in the home would be dangerous. The Virginia State Police may facilitate such storage with local law-enforcement agencies and private entities providing firearms storage services.
