Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 2.2-1118.1 as follows:

§ 2.2-1118.1. Purchasing.

The Commonwealth shall, to the maximum extent practicable, purchase the lowest cost appropriate commercially available products and services to address medical needs and requirements of patients receiving medical care paid for by the Commonwealth, including medical devices that have been reprocessed by reprocessors registered with the United States Food and Drug Administration (FDA) pursuant to 21 U.S.C. § 360, in accordance with applicable requirements of the Federal Food, Drug and Cosmetic Act, 21 U.S.C. § 301 et seq., and applicable implementing regulations promulgated by the FDA.
