Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 7 of Chapter 1 of Title 9.1 a section numbered 9.1-164.1 as follows:

§ 9.1-164.1. Assessment for conviction of certain crimes.

Any county or city that has established a detoxification center program under the provisions of this article may, through its governing body, assess, as part of the costs incident to conviction of any of the following violations which are tried in the courts located within its boundaries, a sum not in excess of $100: §§ 4.1-304, 4.1-305, 4.1-306, 18.2-51.4, 18.2-36.1, 18.2-266, and 18.2-388.

The imposition of such assessment shall be by ordinance of the governing body, which ordinance may provide for different sums in circuit courts and district courts, and the assessment shall be collected by the clerk of the court in which the case is heard and remitted to the treasurer of such county or city and held by such treasurer subject to disbursements by the governing body for developing, establishing, operating, maintaining, or contracting with any qualified public or private agency for local or regional detoxification center programs, services, or facilities.
