Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.2-919.1 as follows:

§ 15.2-919.1. Local regulation of all-terrain vehicles and similar vehicles near dwellings.

A. Any locality may by ordinance provide that any person who operates a dirt bike, all-terrain vehicle, or other similar vehicle, whether licensed or not, within 500 feet of any dwelling shall be guilty of a Class 4 misdemeanor. For purposes of this section, "dwelling" shall not include the vehicle operator's dwelling or any other dwelling where the occupant has given permission for the operation of such vehicle.

B. The parent or other person in loco parentis of a person under the age of 18 years who violates subsection A shall be guilty of a Class 4 misdemeanor.

C. A second conviction under either subsection A or B shall be a Class 3 misdemeanor.

D. Use of such vehicles for agricultural or silvicultural purposes shall be exempt from the provisions of such local ordinance.
