Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 2.2-4314.1 as follows:

§ 2.2-4314.1. Contractor to offer telecommuting or alternative work schedule to employees.

All public bodies shall include in every contract of more than $10,000 the following provisions:

During the performance of this contract, the contractor agrees as follows:

1. The contractor will make every effort to offer telecommuting or alternative work schedules, as defined in § 2.2-2817.1, to its employees except where there is a bona fide occupational qualification reasonably necessary to the normal operation of the contractor. The contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this clause.

2. The contractor will include the provisions of the foregoing paragraph in every subcontract or purchase order of over $10,000, so that the provisions will be binding upon each subcontractor or vendor.
