HB1063: Indoor Clean Air Act; smoking in restaurants in Northern Virginia.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 15.2-2807.1 as follows:
§ 15.2-2807.1. Certain ordinances permitted.
Notwithstanding the provisions of §§ 15.2-2803 through 15.2-2807, the governing bodies of the Counties of Arlington, Fairfax, Loudoun, and Prince William, and the Cities of Alexandria, Fairfax, Falls Church, Manassas, and Manassas Park may enact concurrent ordinances that contain provisions or standards regulating smoking in restaurants which exceed those established in this chapter. For the purposes of this section, "restaurant" means any eating establishment, including, but not limited to, fast food enterprises, coffee shops, cafeterias, and other entities licensed as such by the Board of Health, including a bar area within a restaurant.
2. That the provisions of this act shall not become effective unless at least two-thirds of the Counties of Arlington, Fairfax, Loudoun, and Prince William, and the Cities of Alexandria, Fairfax, Falls Church, Manassas, and Manassas Park, whose populations include at least two-thirds of the population of the aforementioned counties and cities, enact concurrent ordinances containing identical provisions regulating smoking in restaurants. For the purposes of this enactment, "population" means the population as determined by the most recent preceding United States decennial census or the most recent population estimates of the Weldon Cooper Center for Public Service of the University of Virginia, whichever is most recent.
