Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 5 of Chapter 9 of Title 15.2 a section numbered 15.2-977 as follows:

§ 15.2-977. Access to individual social security numbers contained in public records; exceptions.

A. The social security number of any individual contained in the public records of a local government shall be confidential and exempt from disclosure under the Freedom of Information Act (§ 2.2-3700 et seq.).

B. The provisions of this section shall not be construed to prevent the release of a social security number:

1. In accordance with a proper judicial order;

2. To any law-enforcement agency, officer, or authorized agent thereof acting in the performance of official law-enforcement duties; or

3. To any data subject exercising his rights under § 2.2-3806.
