Be it enacted by the General Assembly of Virginia:

1.  That § 46.2-2802 of the Code of Virginia is amended and reenacted as follows:

§ 46.2-2802. Board to employ executive director.

The Board shall employ have an executive director who shall serve at the pleasure of and report to the Board be an employee of the Department, designated by the Commissioner. He shall direct the affairs of the Board and keep records of all proceedings, transactions, communications, and official acts of the Board. He shall be custodian of all records of the Board and perform such duties as the Board may require. The executive director shall call a meeting of the Board at the direction of the chairman or upon written request of three or more Board members. The executive director, with approval of the Board,Commissioner may employ assign such additional Departmental employees to serve as staff to the Board as needed the Commissioner deems necessary. The annual salary of the executive director shall be no greater than Level II of the Executive Compensation Plan contained in the general appropriations act.

2.  That § 46.2-2803 of the Code of Virginia is repealed.
