HB1532: Nursing home beds; Health Commissioner may accept applications
Be it enacted by the General Assembly of Virginia:
1. § 1. Notwithstanding (i) the provisions of §§
32.1-102.3 and 32.1-102.3:2 of the Code of Virginia, (ii) any regulations of
the Board of Health establishing standards for the approval and issuance of Requests
for Applications, and (iii) the provisions of any current Requests for
Applications issued by the Commissioner of Health pursuant to § 32.1-102.3:2 of
the Code of Virginia, the Commissioner of Health [ shall
may ] accept applications and may issue certificates of public need for
nursing home beds [ in Planning District 13 ] that
would result in [ a 50 percent increase in the number of
an increase of 30 ] licensed nursing home beds for each nursing home
that has reported to Virginia Health Information an average annual occupancy
rate of 99 percent or higher for fiscal year 2006 and fiscal year 2007,
provided that the application is filed on or before December 1, 2008, and
approved additional nursing home beds are not put into service prior to July 1,
2009.
Be it enacted by the General Assembly of Virginia:
