Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 8.01-226.12 as follows:

§ 8.01-226.12. Immunity for enforcement of immigration laws.

The Commonwealth or any political subdivsion thereof, or any officers, agents, or employees of the Commonwealth or any political subdivision thereof, shall be immune from liability for the acts or omissions of an employee arising out of the enforcement of any immigration law, so long as such employee (i) was acting pursuant to federal, state, or local authority, (ii) was acting within the scope of the employee's official duties, and (iii) did not commit a violation of federal, state, or local criminal law in the course of enforcing such immigration law.
