HB643: Air emissions; operators of major stationary sources of air pollution to comply with NAAQS.
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 10.1-1308.1 as follows:
§ 10.1-1308.1. Stacks of major stationary sources to meet good engineering practices.
All major stationary sources of air pollution that have stacks that do not meet good engineering practices, and emit one or more of the criteria pollutants (carbon monoxide, sulfur dioxide, oxides of nitrogen, particulate matter 10, particulate matter 2.5, and lead) shall demonstrate a modeled compliance with all National Ambient Air Quality Standards (NAAQS). No later than December 31, 2008, all facilities with such stacks shall provide to the Department modeling results using best available modeling methodologies. If the results of such modeling shows noncompliance with NAAQS or violation of NAAQS, the Department shall, no later than July 1, 2009, issue a permit that ensures modeled compliance with all NAAQS upon issuance of the permit.
