WHEREAS, electronic license plate recognition is a proven mechanism that automatically reads motor vehicle license plate numbers on stationary or moving vehicles; and

WHEREAS, using advanced camera, recognition and database technology the electronic license plate recognition systems automatically capture images of vehicle license plate numbers; and

WHEREAS, the technology can be used at toll plazas to record vehicles that fail to pay the tolls and can instantly check license plate numbers against a variety of vehicle “hot lists” held in target vehicle databases; and

WHEREAS, law enforcement can take appropriate action dependent on the circumstances; now, therefore, be it

RESOLVED by the House of Delegates, the Senate concurring, That the Secretary of Public Safety be requested to study the feasibility of increasing the use of electronic license plate recognition systems as a law-enforcement tool.

In conducting its study, the Secretary of Public Safety shall determine the accuracy, reliability, and cost of the technology and the benefits to state and local law-enforcement agencies, toll authorities and the welfare of the public at large.

Technical assistance shall be provided to the Secretary of Public Safety by the Secretary of Transportation. All agencies of the Commonwealth shall provide assistance to the Secretary of Public Safety for this study, upon request.

The Secretary of Public Safety shall complete its meetings by November 30, 2008, and shall submit to the Governor and the General Assembly an executive summary and a report of its findings and recommendations for publication as a House or Senate document. The executive summary and report shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports no later than the first day of the 2009 Regular Session of the General Assembly and shall be posted on the General Assembly's website.
