Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a fourth enactment to Chapter 819 of the Acts of Assembly of 2007 as follows:

4. That the provisions of this act shall apply to persons who retire from service on or after July 1, 2007, except that, for deputy sheriffs, the provisions of this act shall apply to those deputy sheriffs of a county or city that participates in the Virginia Retirement System (§ 51.1-124.1 et seq. of the Code of Virginia) who (i) retired from service prior to July 1, 2008, under disability retirement pursuant to the Virginia Retirement System, or (ii) retire from service on or after July 1, 2008. Any increase in retirement benefits as a result of this act for any deputy sheriff described in clause (i) shall only be available on a prospective basis, beginning July 1, 2008.
