SB633: Prisoners; notification of child support payments.
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in
Article 1 of Chapter 2 of Title 53.1 a section numbered 53.1-31.2 as follows:
§ 53.1-31.2. Notification of child support due, right to petition for modification of support.
[ A. ] The Department shall
cooperate with the Division of Child Support Enforcement to identify prisoners
of whom child support payments are required pursuant to a court order and to
determine (i) the amount of child support required of the prisoner pursuant to
the order and (ii) the total amount of child support arrearages, including
interest, owed by a prisoner upon intake, at regular intervals but at least
annually thereafter, and no more than 30 days prior to discharge.
[ B. The Department shall provide notice to each
prisoner of whom child support payments are required pursuant to a court order
of their right to seek a modification of an order pursuant to which they may be
obligated to pay child support. Such notice shall be provided at the time of
intake and shall include information regarding the requirements and procedures
for seeking a modification of a child support order, on such a form prescribed
and provided to the Department by the Division of Child Support Enforcement.
