Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.2-1511.01 as follows:

§ 15.2-1511.01. Allowances to injured deputy sheriffs.

A. In addition to the allowances provided in § 15.2-1511, any deputy sheriff who suffers injury as defined in Title 65.2 and whose allowance as provided in § 15.2-1511 is less than 100 percent of his regular compensation shall be entitled to use any accrued vacation, compensatory, or sick leave to supplement the allowance so as to receive 100 percent of his regular compensation. In no case shall a deputy sheriff use such accrued leave so as to receive more than 100 percent of his regular compensation.

B. The governing body of a locality shall continue to pay any employer's share of the cost of health insurance coverage, to the same extent as for other employees of the locality covered by the health insurance plan, for a participating deputy sheriff who suffers injury as defined in Title 65.2 and for his family and dependents,  [ if his family and dependents were covered under the health insurance plan prior to the injury,  ] regardless of the length of time that the deputy sheriff receives compensation under Title 65.2.
