Description
Drug-related personal injury actions; limitations. Extends the two-year statute of limitations for personal injury actions in cases where the injury (i) is latent or by its nature not discoverable at the time of its occurrence and (ii) is the result of the ingestion of or exposure to a drug for a period of one year from the date the injury is discovered or reasonably should have been discovered. Amends § 8.01-243 (“Personal action for injury to person or property generally; extension in actions for malpractice against health care provider.”), of the Code of Virginia. View Full Text »
