HB1074: Motor vehicle insurance; consideration of driving record.
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 38.2-1904.1 as follows:
§ 38.2-1904.1. Motor vehicle insurance premiums; consideration of driving record.
A. Upon (i) the initial underwriting of an individual for a motor vehicle insurance policy, (ii) re-underwriting an insured under a motor vehicle insurance policy after a break in coverage of not less than 30 days, or (iii) re-underwriting the insured under a motor vehicle insurance policy by an insurer providing continuing coverage for an insured, the insurer shall examine the current driving record of the named insured and any regular driver of a motor vehicle insured under the policy as maintained by the Department of Motor Vehicles.
B. Notwithstanding any other provision of this title, the information obtained by the insurer's examination of such driving record shall be considered, but shall not exclude the consideration of any other relevant information, by the insurer in establishing the premium for the insured under a policy of motor vehicle insurance.
