Be it enacted by the General Assembly of Virginia:

1. § 1. Special license plates for persons with certain medical conditions.

On receipt of an application and presentation of payment of the fee prescribed by this section the Commissioner of the Department of Motor Vehicles shall issue to the applicant special license plates to applicants with any of the following medical conditions: (i) asthma, (ii) diabetes (insulin dependent), (iii) diabetes (pill dependent), (iv) epilepsy, (v) heart disease, and (vi) paralysis. The Commissioner shall request that the application be accompanied by a certification signed by a licensed physician, licensed podiatrist, licensed chiropractor, licensed nurse practitioner, or licensed physician assistant that the applicant has the medical condition identified in his application.

On application of an organization, the Commissioner shall issue disabled parking license plates for vehicles registered in the applicant's name if the vehicles are primarily used to transport persons with disabilities.

Special license plates issued under this act shall be of distinct designs, depending upon the medical condition of the person to whom they are issued. The Commissioner of the Department of Motor Vehicles, in consultation with the Department's Medical Advisory Board, shall, by regulation, establish detailed requirements for issuance of special license plates under this act.

For each set of license plates issued pursuant to this act, the Commissioner shall charge, in addition to the prescribed cost of state license plates, a one-time fee of $15 at the time the plates are issued. All fees imposed under the provisions of this section shall be paid to, and received by, the Commissioner of the Department of Motor Vehicles, and paid by him into the state treasury and set aside as a special fund to be used to meet the necessary expenses incurred by the Department of Motor Vehicles.

The provisions of subdivisions B 1 and B 2 of § 46.2-725 of the Code of Virginia shall not apply to license plates issued pursuant to this act.
