Be it enacted by the General Assembly of Virginia:

1.  § 1. That during the 2010-2012 biennium, any local school division of the Commonwealth that experiences a reduction of five percent or more of its state share of the per pupil amount of basic aid may negotiate an agreement with the Board of Education for flexibility in meeting specific state education mandates whose implementation may be impacted by such reduction. No flexibility shall be offered with regard to those state mandates that are also required by federal code, federal regulation, or court action.

2.  That the provisions of this act shall expire on June 30, 2012.
