Be it enacted by the General Assembly of Virginia:

1. That § 19.2-265.3 of the Code of Virginia is amended and reenacted as follows:

§ 19.2-265.3. Nolle prosequi entered in discretion of court.

Nolle prosequi shall be entered only in the discretion of the court, upon motion of the Commonwealth ~~with good cause therefor shown~~.
