Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 55-79.80:4 and 55-513.2 as follows:

§ 55-79.80:4. Operation of motor vehicles; authority of unit owners' association.

Except to the extent otherwise expressly provided by the condominium instruments, no unit owners' association shall have the authority to establish rules or restrictions concerning the operation of privately owned motor vehicles within the common areas or other areas under the authority of the unit owners' association.

§ 55-513.2. Operation of motor vehicles; authority of association.

Except to the extent otherwise expressly provided by the declaration, no association shall have the authority to establish rules or restrictions concerning the operation of privately owned motor vehicles within the common areas or other areas under the authority of the association.
