Description

Capital murder; jury sentencing.  Provides for jury sentencing of a defendant who has entered a plea of guilty to capital murder. A defendant who enters a guilty plea may still be sentenced by the judge if all parties agree. This bill is a recommendation of the Virginia Criminal Justice Conference. Amends § 19.2-257 (“Trial without jury in felony cases.”), § 19.2-264.3 (“Procedure for trial by jury.”), of the Code of Virginia. View Full Text »
