Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 38.2-3401.1 as follows:

§ 38.2-3401.1. Offering abortion coverage through health care exchange permitted.

Any qualified health benefits plan offered through an exchange established in the Commonwealth pursuant to and as a result of the federal Patient Protection and Affordable Care Act, P.L. 111-148, as amended, shall be neither required to provide nor prohibited from providing insurance coverage for abortion services. Any such plan shall determine whether coverage of abortion services shall be offered.
