Description

Shelters of last resort; immunity.  Provides civil immunity, except in cases of gross negligence or willful misconduct, to persons who own or control property used as a shelter of last resort in response to a disaster. A shelter of last resort is defined as a place of refuge that provides short-term protection for persons who have been displaced by a disaster, but does not necessarily provide life-sustaining services. Such immunity only attaches if a request to use such property as a shelter of last resort was made by the Virginia Department of Emergency Management or a local emergency management organization and a state or local emergency has been or is subsequently declared.
