Description
Sentencing proceeding by the jury after conviction. Provides that criminal sentencing by a jury shall be done by a different jury when the original jury cannot agree on punishment, unless the parties and the court agree to sentencing by the court. To not settle sentencing swiftly, or to risk mistrial when jurors do not agree unanimously on sentencing, is to potentially victimize the victim and/or victim's family again, by way of the very system that was designed to support them.
