Description
Welfare and other entitlement fraud; penalties. Requires a 180-day mandatory minimum sentence for misdemeanor entitlement fraud, a one year mandatory minimum sentence for felony entitlement fraud, a repayment of three times the benefits received, and a lifetime bar on receipt of entitlement. The entitlements covered by the bill are housing assistance programs, medical assistance, food stamps, energy assistance, and any other program designated under regulations of the State Board of Social Services, State Board of Health, or Board of Medical Assistance Services. Amends § 18.2-186.2 (“False statements or failure to disclose material facts in order to obtain aid or benefits under any local, state or federal housing assistance program.”), § 32.1-321.4 (“False statement or representation in applications for eligibility or for use in determining rights to benefits; concealment of facts; criminal penalty.”), § 63.2-522 (“False statements, representations, impersonations and fraudulent devices; penalty.”), § 63.2-523 (“Unauthorized use of food stamps, electronic benefit transfer cards, and energy assistance prohibited; penalties.”), of the Code of Virginia.
