Description

Divorce; evidence by affidavit. Provides that if a party has filed for divorce on fault grounds and moves pursuant to 20-121.02 for a divorce on no-fault grounds without amending the pleadings, the party may submit to the court an affidavit in support of such no-fault grounds. The bill also clarifies that in order to file a divorce or annulment action in the Commonwealth, at least one of the parties to the action must have been for at least six months preceding the filing of the action an actual bona fide resident and domiciliary of the Commonwealth. This bill is a recommendation of the Boyd-Graves Conference. Read the Bill »
