Description
Transportation Trust Fund; funding in connection with rezoning application; road capacity. Allows a locality to deny or modify a request for rezoning when the existing and future transportation network that will serve the proposed development is inadequate to handle the anticipated transportation impact of the proposed development. The bill also provides that the Department of Transportation shall collect cash payments, in lieu of cash payments or proffers accepted by a locality, in an amount equal to that a locality could accept pursuant to its ability to accept proffers if the inadequacy of the existing and future transportation network that would serve the proposed development, as determined by such locality in accordance with subsection A, gives rise to the need for such cash payments or proffers.
