A BILL to amend Chapter 884 of the Acts of Assembly of the 2006 Regular Session by adding sections numbered 4 and 5, relating to the conveyance of subaqueous land.

Be it enacted by the General Assembly of Virginia:

1. That Chapter 884 of the Acts of Assembly of the 2006 Regular Session is amended by adding sections numbered 4 and 5 as follows:

§ 4. Upon sufficient information presented to the Marine Resources Commission that (i) the parties authorized to be conveyed parcels of subaqueous land in §§ 1, 2, and 3 were not responsible for any unauthorized filling of subaqueous land, (ii) any subaqueous land identified in §§ 1, 2, and 3 that has been filled was filled prior to January 1, 2006, and (iii) the parties authorized to be conveyed the parcels identified in §§ 1, 2, and 3 have paid real property taxes on such subaqueous land during the time the parcels were held or purported to be held by the parties, the Marine Resources Commission shall, as a matter of equity, consider the prior payment of such real property taxes as satisfaction of the fair market value for such parcels.

§ 5. The Marine Resources Commission may charge a reasonable fee for the cost of preparing any instrument required to accomplish the conveyances.
