Description
Pharmacy benefits management. Prohibits a covered entity from contracting for pharmacy benefits management unless the pharmacy benefits manager has agreed in writing that the pharmacy benefits manager shall not keep any incentive or compensation from a manufacturer or distributor with regard to the policyowners claims. The pharmacy benefits manager is also required to agree to disclose its actual acquisition costs and any rebates or compensation from a manufacturer or distributor. A pharmacy benefits manager is prohibited from charging more for drugs than the pharmacy benefits managers actual acquisition costs for the drug, except for an administrative fee. In addition, pharmacy benefits managers shall agree to give the group or individual policyowner the right to audit its records. Read the Bill »
