Description

Designation of persons authorized to make funeral and burial decisions. Designates the persons in order of priority who have the ability to make all necessary arrangements for a decedent's funeral and the disposition of his remains. This bill is in response to recent cases in Virginia concerning who had the right to make such decisions. Current law allows any next of kin to make arrangements, without specifying an order of priority. This bill grants funeral services providers civil immunity for decisions made if there is a dispute among members of the same class, in the absence of bad faith.
