AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 46.2-928.1, relating to pedestrians crossing railroad grade crossings.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-928.1 as follows:

46.2-928.1. Pedestrians crossing certain railroad grade crossings; penalty.

No pedestrian shall cross any railroad grade crossing controlled by lights and crossing gates if a train or locomotive is approaching and warning indicators are activated.  Any person violating this section shall be guilty of a Class 3 misdemeanor.
