A BILL to amend the Code of Virginia by adding a section numbered 55-513.01, relating to the Property Owners' Association Act; authority of board of directors; parking.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 55-513.01 as follows:

? 55-513.01. Adoption of rules related to parking; apportionment of common expenses.

A. To the extent the declaration gives the board of directors the authority to adopt rules and regulations relating to the parking of motor vehicles by lot owners, such rules may establish a parking space designation plan which makes parking spaces available to less than all of the lot owners.

B. If such a plan is adopted, the common expenses attributable to such parking spaces ?[ shall may ] be specially assessed against the lot owners involved. [ The board may impose reasonable user fees.

C. The amount of all common expenses not specially assessed pursuant to subsection B shall be assessed equally against all of the lot owners. Such assessments shall be made by the association annually, or more often if the declaration so provides. ]
