A BILL to amend and reenact § 3.1 of Chapter 211 of the Acts of Assembly of 1996, which provided a charter for the Town of Duffield, relating to election of town council members.

Be it enacted by the General Assembly of Virginia:

1.  That § 3.1 of Chapter 211 of the Acts of Assembly of 1996 is amended and reenacted as follows:

§ 3.1. Council.

A. The Town of Duffield shall be governed by the town council, composed of five members, elected at large.

B. The members of council in office at the time of the passage of this act shall continue until the expiration of the terms for which they were elected, or until their successors are duly elected and qualified.

C. In each even-numbered year, Beginning in 2010 and every four years thereafter on the dates specified by general law for municipal elections, the five members of the council shall be elected for terms of two four years each. The persons so elected shall qualify and take office on July 1 following their elections, and they shall continue to serve until their successors are duly elected and qualified and assume office.

D. Any person qualified to vote in town elections shall be eligible for the office of councilman.

E. Vacancies on the council shall be filled for the unexpired term by a majority vote of the remaining members of the council. Any person qualified for the office of councilman may be chosen to fill a council vacancy.

2.  That an emergency exists and this act is in force from its passage.
