I installed a six feet vinyl privacy fence at the back yard of my house. The fence was approved by the Prince William County building office, VA. But Port Potomac Home Owners Association did not allow this fence. They wanted not fence more than 4 feet and should not be of vinyl. The county had no objection and we have approval. Due to HOA's rigid attitude, we had to remove the fence and all vinyl panels on which I spent a lot of money are lying in my home garrage. Would you kindly advise the HOA of Port Potomac to allow six feet privacy wall and vinyl panels as per PWC regulations. Thanks for your necessary action.

Having lived in HOAs for many years and having been on the Board of Directors of condos and HOAs for many years, you will end up being out of luck.

Prince William County can approve you fence but that doesn't mean you can put up the fence the county approved. You are still subject to the architectural requirements of the HOA and they can be much more restrictive than the County's and that's just the way it is. When you purchased your unit you agreed to the By-Laws and Declaration of Covenants of the HOA. Even if you don't like them and the County would allow you do something different, you are still restricted. As long as the HOA's documents are legally recording and not invalidated by federal or state law, you are subject to those restrictions placed by the HOA.
