SB677: Stormwater management regulations; extends effective date that establishes local program criteria.

A BILL to amend and reenact the second enactment of Chapter 18 of the Acts of Assembly of 2009 and to amend Chapter 18 of the Acts of Assembly of 2009 by adding a third enactment, relating to stormwater management programs.

Be it enacted by the General Assembly of Virginia:

1.  That the second enactment of Chapter 18 of the Acts of Assembly of 2009 is amended and reenacted as follows:

2. That the regulation that establishes local program criteria and delegation procedures and the water quality and water quantity criteria, that is referenced in subsections A and B of ? 10.1-603.3 of this act, shall not become effective prior to July 1, 2010 2011.

2. That Chapter 18 of the Acts of Assembly of 2009 is amended by adding a third enactment as follows:

That the Department of Conservation and Recreation, in consultation with the Department of Environmental Quality, shall review the regulations described in the second enactment of this act to determine the effect the development of the total maximum daily load (TMDL) allocation for the Chesapeake Bay may have on such regulations. If the Department of Conservation and Recreation determines that the TMDL implementation plan as approved by the U.S. Environmental Protection Agency requires a change in the criteria described in the second enactment of Chapter 18 of the Acts of Assembly of 2009, as amended by this act, the Virginia Soil and Water Conservation Board shall adopt a regulation that is consistent with the source allocations made in the approved TMDL plan.
