Description

Virginia Water Protection Permits; multiagency review; urgent public health need.  Requires the Department of Environmental Quality to identify projects as having an urgent public health need if such project (i) is funded by the Virginia Water Quality Improvement Fund, (ii) is being constructed or directed by a local water authority, and (iii) will mitigate the pollution of residential drinking water sources or will provide safe drinking water in locations where such water is not readily available. When a project is designated as having an urgent public health need, other agencies that must provide comments within 45 days shall do so or shall be deemed to have approved the permit without further opportunity to comment. Currently, other agencies such as the Department of Game and Inland Fisheries, the Department of Conservation and Recreation, the Virginia Marine Resources Commission, the Department of Health, and the Department of Agriculture and Consumer Services must provide comments within 45 days, but the consequences of a failure to do so in a timely manner are not set out.
