A BILL to amend the Code of Virginia by adding a section numbered 46.2-1003.1, relating to issuance and processing of citations for certain motor vehicle equipment violations.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 46.2-1003.1 as follows:

§ 46.2-1003.1. Citations for vehicle equipment violations.

In the case of any violation or violations of any provision of this chapter that involve only defective equipment, unauthorized equipment, missing equipment, or malfunctioning equipment and are punishable solely as traffic infractions, any citation for the alleged offense shall be issued by the officer on a form suitable for a repair technician to provide his written certification that the defect has been repaired within 24 hours of issuance of the citation or before midnight of the next working day following holidays or weekends and that the vehicle is in proper working order. If such form is promptly and properly returned by mail or otherwise to the court having jurisdiction, the court shall dismiss the charge.
