Be it enacted by the General Assembly of Virginia:

1.  That § 4.1-304 of the Code of Virginia is amended and reenacted as follows:

§ 4.1-304. Persons to whom alcoholic beverages may not be sold; proof of legal age; penalties.

A. No person shall, except pursuant to subdivisions 1 through 5 of § 4.1-200, sell any alcoholic beverages to any person individual when at the time of such sale he knows or has reason to believe that the person individual to whom the sale is made is (i) less than twenty-one 21 years of age, (ii) interdicted, or (iii) intoxicated.

B. In addition, when at the time of such sale such person knows or has reason to believe that the individual to whom the sale is made is less than 21 years of age, such person shall require the individual to present a photo identification form issued by a governmental agency or an educational institution that contains the individual's complete name, gender, and date of birth, indicating that the individual is 21 years of age or older. Failure to require identification as provided in this subsection shall be deemed a violation of this section.

C. Any person convicted of a violation of this section shall be guilty of a Class 1 misdemeanor.
