Description

Asbestos workers; violations; penalties.  Requires the Commissioner of Labor and Industry to maintain a registry of employee complaints alleging the existence or imminent threat of an asbestos NESHAP violation. The measure prohibits employers from discharging or otherwise penalizing an employee who files a complaint in good faith. An employee who is subject to retaliation may bring an action against the employer for reinstatement and other remedies. The Commissioner is required to keep the identity of any employee filing a complaint confidential, and such information generally will be exempt from the Freedom of Information Act. The measure also provides that the amount of any noncompliance penalty for a violation shall not be less than $2,000 per violation or more than $25,000 for multiple violations. Read the Bill »
